1. Agreement and beta status
These Terms of Service (the “Terms”) govern your access to and use of RackPulse websites, applications, models, workflows, documentation, and related beta services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. RackPulse is offered from the United States and is intended for users who may lawfully use it under applicable law. The Service is an evolving beta: features may be added, changed, limited, or removed, and access may be invite-only or discretionary.
2. Accounts and access
You are responsible for providing accurate account information, protecting your credentials, and activity under your account. You must be at least 18 years old or have the permission and supervision of a parent or legal guardian. We may decline, limit, suspend, or terminate access when reasonably necessary to protect the Service, users, RackPulse, or others.
3. Limited license
Subject to these Terms, RackPulse grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial hunting and scouting purposes during your authorized access period. This license does not transfer any ownership interest in the Service or RackPulse intellectual property to you.
4. RackPulse intellectual property
As between you and RackPulse, RackPulse and its licensors retain all right, title, and interest in and to the Service and all related intellectual property, including software, source and object code, models, prompts, workflows, methods, interfaces, designs, branding, trademarks, content, documentation, data structures, analysis outputs, and all feedback, derivatives, and improvements. You may not use RackPulse names, logos, or trademarks without our prior written permission.
5. Your uploads and feedback
You retain any rights you have in photos, videos, notes, and other content you submit to the Service (“Your Content”). You grant RackPulse a non-exclusive, worldwide, royalty-free license to host, reproduce, process, adapt, display, and use Your Content only as reasonably necessary to operate, secure, support, troubleshoot, evaluate, and improve the Service and its models and workflows, consistent with the Privacy Promise and your account controls. Do not submit content you do not have the right to submit. If you send feedback, suggestions, or ideas, you grant RackPulse a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.
6. Restrictions
You may not, and may not permit another person to: copy, modify, distribute, sell, lease, sublicense, or resell the Service; reverse engineer, decompile, disassemble, or attempt to derive source code, models, prompts, or underlying ideas; scrape, crawl, harvest, or systematically extract Service data or outputs; perform model extraction, model training, or competitive benchmarking; bypass rate limits, authentication, paywalls, or other access controls; use automated means except as expressly authorized in writing; interfere with Service security or availability; or use RackPulse intellectual property or trademarks without written consent.
7. Beta confidentiality
Non-public beta features, access codes, roadmaps, documentation, performance information, product concepts, and other materials identified as confidential or that reasonably should be understood as confidential are RackPulse confidential information. You may use them only to evaluate and use the beta as permitted by these Terms and may not disclose them to third parties without RackPulse’s written consent. This obligation does not apply to information that you can demonstrate was lawfully public without breach of these Terms.
8. User conduct and content rules
You may not use the Service unlawfully or to facilitate trespass, poaching, harassment, wildlife harm, unsafe conduct, or a violation of property, hunting, conservation, privacy, or export laws. You may not upload malicious code, infringing material, personal information about others without authorization, or content that is deceptive, abusive, or otherwise unlawful. You remain responsible for your field decisions and for complying with local laws, landowner rules, licensing requirements, and safe hunting practices.
9. AI, wildlife, and safety limitations
RackPulse may generate automated or AI-assisted outputs, including wildlife identification, age-class impressions, rack or score estimates, activity patterns, heatmaps, and safety-related suggestions. These outputs are estimates for general informational use only. They may be inaccurate, incomplete, unavailable, or inappropriate for your situation. Do not treat them as professional wildlife, veterinary, legal, safety, navigation, emergency, or land-access advice, and do not rely on them as the sole basis for a field or safety decision.
10. Privacy and location data
Our handling of personal information and scouting context is described in the RackPulse Privacy Promise. In particular, the current Private Patterning workflow is designed to avoid saving raw originals, EXIF/GPS, exact pins, property boundaries, routes, or maps. You are responsible for the information you choose to provide. Any future aggregate insight or heatmap is subject to the privacy commitments described in the Privacy Promise.
11. Suspension and termination
You may stop using the Service at any time. RackPulse may suspend or terminate your access, or remove content, if we reasonably believe you breached these Terms, created risk or legal exposure, or materially impaired the Service or other users. On termination, the license in Section 3 ends. Sections that by their nature should survive, including intellectual property, feedback, confidentiality, disclaimers, limitations of liability, indemnity, and governing terms, will survive.
12. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” RACKPULSE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not warrant that the Service will be secure, available, accurate, complete, or suitable for your needs.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACKPULSE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID RACKPULSE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless RackPulse and its affiliates, licensors, and service providers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to Your Content, your use of the Service, your violation of these Terms, or your violation of law or another person’s rights.
15. Governing law and venue — legal review required
Governing law and exclusive venue are intentionally not finalized in this beta template. Before public commercial rollout, RackPulse will designate the governing U.S. state and the state and federal courts with exclusive venue here: [GOVERNING STATE] and [COUNTY / JUDICIAL DISTRICT]. Until then, this section should not be treated as a jurisdiction selection by RackPulse.
16. Changes and contact
We may update these Terms as the Service evolves. We will post the updated version and revise the “Last updated” date below.
